Supreme Court orders review of Janet Jackson 'wardrobe malfunction' case

The U.S. Supreme Court on Monday ordered a lower court to re-examine a decision involving Janet Jackson's famous 2004 Super Bowl "wardrobe malfunction."
The high court told a federal appeals court in Philadelphia to reconsider a decision that cleared CBS of a $550,000 fine from the Federal Communications Commission. The lower court ruled that Jackson's brief breast exposure constituted a "fleeting" image that should not have been fined.
But the Supreme Court took a slightly different approach on Monday, just days after a separate controversial ruling on FCC policy regarding the use of profanity.
